Distance Sales Agreement

The subject of this Agreement is the sale and provision of the digital content-protection subscription services purchased by the Buyer through the website, and the parties' rights and obligations in connection with that sale, in accordance with applicable distance-selling and consumer-protection regulations.

The essential characteristics, scope, and price of the service are displayed on the website before purchase and are confirmed at checkout. The Buyer confirms having received this pre-contractual information.

Nemaries provides digital services including automated scanning for infringing content, DMCA takedown submissions, and search-engine delisting (Google and Bing) on behalf of the Buyer. Services are delivered entirely online as a subscription; no physical product is shipped.

The specific features, quotas, and limits applicable to the Buyer's subscription are those of the plan selected at the time of purchase.

• All prices and the applicable billing period (e.g. monthly or annual) are shown on the website and at checkout, including any applicable taxes.
• Payments are processed securely through our payment provider iyzico. We accept Mastercard, Visa, American Express, and Troy cards. Card details are handled by the payment provider and are not stored on our servers.
• Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. The Buyer may cancel auto-renewal at any time from account settings or by contacting us.

Because the service is digital and intangible, "delivery" means activation of the subscription and access to the service. Access is provisioned immediately (and in any case within 24 hours) after the payment is successfully confirmed, through the Buyer's account on nemaries.com.

There is no shipping, and no shipping fee is charged. The service is accessed remotely via the Buyer's account for the duration of the subscription period.

For digital services, the Buyer has a right of withdrawal within 14 days of purchase, provided that performance of the service has not yet begun with the Buyer's prior express consent.

Important: When the Buyer requests that the service start immediately upon purchase, the Buyer expressly consents to the commencement of performance and acknowledges that the right of withdrawal is lost once the service has been fully performed. Where performance has only partially occurred, a pro-rata charge for the portion already provided may apply.

Approved refunds are returned to the original payment method through iyzico, typically within 14 days of approval. The time for the amount to appear on the Buyer's statement depends on the card issuer or bank.

This Agreement remains in effect for the duration of the Buyer's subscription. Either party may terminate the subscription at the end of the current billing period. The Seller may suspend or terminate the service in the event of a material breach of this Agreement or misuse of the service.

Personal data provided under this Agreement is processed in accordance with our Privacy Policy and GDPR Notice.

This Agreement is governed by applicable consumer-protection and distance-selling laws. Consumers may exercise any statutory rights available to them, including bringing disputes before the competent consumer arbitration committees or courts of their jurisdiction.
